Welcome to Lightening POS. By subscribing to our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

Subscription and Payment Terms

  • Subscription: Our services are offered on a subscription basis, with payment due monthly or annually as per your chosen plan.
  • Billing: Payments are made in advance and are non-refundable. We accept payment via credit card or ACH transfer.
  • Lease: the contrast is non-cancelable (12,24,36 & 48 months).
  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel your subscription through your account settings.

Usage Rights and Restrictions

  • License: You are granted a limited, non-exclusive, non-transferable license to use our software and services during the term of your subscription.
  • Restrictions: You may not decompile, reverse engineer, or otherwise attempt to access the source code of our software. Unauthorized use of our services is prohibited.

Data Privacy and Security

  • Data Collection: We collect and use personal data in accordance with our Privacy Policy. You agree to comply with all applicable data protection laws.
  • Data Security: We implement appropriate measures to protect your data. However, you are responsible for maintaining the confidentiality of your account credentials.

Service Availability and Support

  • Uptime: We strive to provide continuous service but cannot guarantee uninterrupted access due to factors beyond our control.
  • Support: Customer support is available during business hours via email and phone. Please refer to our Support Policy for more details.

Termination

  • For Non-Payment: We reserve the right to suspend or terminate your access to our services if your account becomes delinquent.
  • For Breach: Any violation of these terms may result in termination of your account without notice.
  • Effect of Termination: Upon termination, your access to our services will cease, and we may delete your data after 30 days.

Indemnification and Liability

  • Indemnification: You agree to indemnify and hold us harmless from any claims arising out of your use of our services.
  • Limitation of Liability: Our liability is limited to the amount paid by you for the services in the last 12 months. We are not liable for any indirect, incidental, or consequential damages.

Compliance with Laws

  • Marketing and Communications: You must comply with all applicable laws regarding unsolicited communications, including the CAN-SPAM Act and TCPA.
  • General Compliance: You agree to comply with all local, state, and federal laws applicable to your use of our services.

Amendments

  • Changes to Terms: We may update these terms from time to time. Any changes will be posted on our website, and your continued use of the services constitutes acceptance of the new terms.

  • Contact: Any notices to us should be sent via email to contact@lighteningPOS.com. Notices to you will be sent to the email address on record in your account.

Governing Law

  • These terms are governed by and construed in accordance with the laws of TN/USA, without regard to its conflict of law principles.
